1. DEFINITIONS
"You/Your" means You, the user, "We/Us" means Chelsea Digital Media plc and adidas AG. "Chelsea Site" shall have the meaning as set out above. "User Information" means the personal details which may be provided by You to Us via the Chelsea Site. "Users" means the users of the Chelsea Site collectively and/or individually as the context admits. "Website" means a site on the World Wide Web.
2. ACCEPTABLE USE
We insist that any use by You of the Chelsea Site shall be in accordance with the following conditions:

2.4 We cannot guarantee anonymity if you do not abide by these terms and conditions or post anything illegal onto the site.
3. THIRD PARTY WEBSITES
3.1 You acknowledge and agree that We are not responsible for the availability of any third party Websites or material You access through the Chelsea Site, and do not endorse and are not responsible or liable for any content, advertising, products or services on or available from such Websites or material, nor for any damage, loss or offence caused, or alleged to be caused, by or in connection with use of or reliance on any content, advertising, products or services available on or available from such Websites or material.
3.2 Any dealings between You and any advertisers or merchants found on or via the Chelsea Site, including payment for and delivery of products, services and any other terms, conditions, warranties or representations, associated with such dealings, are solely between You and the relevant advertiser or merchant. You agree not to hold Us liable for any loss or damage of any kind incurred as the result of any such dealings.
4. INTELLECTUAL PROPERTY
4.1 All copyright, trade marks and all other intellectual property rights in all material or content supplied as part of the Chelsea Site shall remain at all times vested in Us or Our licensors. You are permitted to use this material or content only as expressly authorised in writing by Us or Our licensors and may not and agree not to assist or facilitate any third party to copy, reproduce, transmit, distribute, commercially exploit or create derivative works of such material or content.
4.2 If You become aware of any such distribution or commercial exploitation, You agree to notify Us immediately.
4.3 You acknowledge that by posting materials on the Chelsea Site You grant to Us and Our licensors and assigns an irrevocable, perpetual royalty free worldwide licence to use the materials within the Chelsea Site and in any other manner. The licence extends to copying, distributing, broadcasting, and otherwise transmitting, and adapting and editing the materials.
5. CHELSEA'S RIGHTS
5.1 Material which is posted on any bulletin boards or chat forums is written by Users and We are not responsible for and give no endorsement of such material. We reserve the right to monitor the contributions and may respond to or comment upon communications by You and edit, refuse to post or remove any content from the bulletin boards and chat forums in our absolute discretion. No failure to remove particular material constitutes an endorsement or acceptance of it by Us.
5.2 To the extent permitted by law, We make no warranties, express or implied, as to the content of the Chelsea Site or the accuracy, timing or reliability of any information or statements contained therein, or statements, advice and opinions given by Users on the bulletin boards and chat forums which are those of such Users only. We neither endorse nor shall be held responsible for the reliability or accuracy of the same and We are not responsible in any way for any injury, loss or damage which occurs as a result of an opinion expressed or information provided on the Chelsea Site. If You have any claim arising from the actions or statements of another User, You agree to pursue such a claim only against that User and not from Us.
5.3 We will endeavour to provide the Chelsea Site using all reasonable care. 6.1 We shall comply with applicable UK Data Protection legislation from time to time in place in respect of any personal information relating to You gathered by Us.
6.2 You may be asked to input various basic information about yourself on different pages of the Chelsea Site. At each location where information is requested there is a statement about the purpose for which that information will be used. We will not use the information given for any other purpose than that stated at each location or as set out in Our Privacy Policy which sets out further information about our use of User Information.

These terms and conditions are governed by English law and both You and Us hereby submit to the non-exclusive jurisdiction of the English courts.

Upon Your request, We will use commercially reasonable efforts to delete Your Personal Information from Our database. However, it may not be possible to delete an entry without some delay and without retaining some residual Personal Information because of backups and records of deletions.

You have the right to contact Us in order to find out what Personal Information We hold about You. Please note that a small fee will be payable towards the cost of administering any request You make. The current fee is £10.

19. Children's Privacy Policy
By continuing to use the Chelsea Site and any of the services offered, You are confirming that you have received the consent of your parent or a guardian to use the Chelsea Site.
19.1 Protection of Children's Personal Information
We encourage children to speak to their parents before submitting any Personal Information to the Chelsea Site and also recommend that parents supervise their children while they are online. There are various control tools available for online services that We advise parents to utilise in order to create a child-friendly online environment for their children.
We are dedicated to the protection of children's Personal Information and We do not actively market to children. It is Our policy not to make a child's participation in a Chelsea Site activity contingent on the child disclosing any more Personal Information than is reasonably necessary in order to do so.
19.2 Obligations on those under 18 years old
In order to protect children, those who are under the age of 18 must always ask their parent/guardian before they:

19.3 Reviewing/Deleting Children's Personal Information
A parent/guardian may submit a request via email/in writing to the address set out in paragraph 3 above to stop any additional use of a child's Personal Information or to request that We delete the Personal Information. Before disclosing information about a child, We may request that the parent/guardian provide reasonable information about the child for identification purposes (e.g. child's name, address, telephone number etc).
Adidas / Chelsea FC T&C’s
By entering the ‘Promotion’ you agree to be bound by these terms and conditions.
• The promotion is open to UK residents, excluding employees and their immediate families of adidas, their agents, or anyone else professionally connected with the promotion.
• The promotion is open from 2nd February 2012 to 8th February 2012 inclusive.
• To enter, fill in your personal details and upload a video in the fields provided at www.allblues.chelseafc.com to show us why you are a true fan. The Promoter will select winning candidates at their sole discretion.
• Entrants must be 16 years or older. You will be asked to sign an NDA (Non Disclosure Agreement) on the day as all involvement is strictly confidential until launch.
• 8 winners will be selected on Wednesday 8th February and notified by telephone or email on or within 3 days of the selection. The selection is for the individual only and is non-exchangeable and non transferable. There is no cash alternative.
• The successful candidates will be involved on a photo-shoot on Wednesday 15th February at the Chelsea training ground. There will be no alternative date. Travel expenses within the London area with be paid for and lunch and drinks will be provided. The candidate can be accompanied by a parent or legal guardian (at their own expense).
• By participating in the promotion the candidates herby grant the Promoter, the right and permission to do the following;
• Photography, film and record images
• Use, edit, adapt, reproduce, license or otherwise exploit the images/footage including without limitation in connection with the internet, film, video and other broadcasting media, consumer, trade, regional, outdoor advertising, and / or publicity, each whether above or below the line, public relations, editorial, in-store collateral, any point of sale material, signage, brochures, postcards and/or education materials, for up to the duration of 1 year from August 2012.
• adidas and Chelsea FC will not share any details provided with any other third party. The personal details of participants provided with entries to the Promotion will be collated and stored by the Promoters and held in accordance with their privacy policies in place from time to time. • The Promoter's decision regarding all promotional matters will be final and binding and no correspondence will be entered into.
• If there is any reason to believe that there has been a breach of these terms and conditions the Promoter may, at its sole discretion reserve the right to exclude the ‘individual’ from the participation. The Promoter deserves the right to modify, cancel, terminate or suspend the Promotion in whole or in part, at their sole discretion.
• The Promoter is will not be responsible for any damage, loss or injury resulting from participants’ entry into the promotion.
• These Terms and Conditions shall be governed and construed in accordance with the laws of England and Wales. Any dispute arising is subject to the exclusive jurisdiction of the courts of England and Wales.
